Buy Clean California Act and Caltrans Right of Way Projects

Notice for Local Agencies of the Buy Clean California Act (BCCA) as it pertains to projects in the Caltrans Right of Way.

The BCCA (Public Contract Code Sections 3500-3505) is part of California’s overall strategy to address climate change. The BCCA applies to any public works project that is subject to the State Contract Act, which includes projects under Caltrans jurisdiction on the State Highway System. Projects with bid opening dates of July 1, 2022, or later need to meet the BCCA requirements. The technical provisions for these projects shall include the language in Caltrans standard special provision for Section 6-1.06, “Buy Clean California Act”.

The BCCA requires facility specific Environmental Product Declarations (EPDs) reflecting Global Warming Potential (GWP) values within the limits set forth by the Department of General Services (DGS) for specified structural steel, flat glass, and mineral wool board insulation. For concrete reinforcing steel, mills need to be on the Caltrans Materials Engineering and Testing Services (METS) Authorized Materials list for BCCA EPDs.
