Changes in Conditional Right of Way Certification No.3 and Special Right of Way Certification No. 3 with Work-Around (3W)


Effective: August 2024

Due to changes in the Stewardship and Oversight Agreement between Caltrans and the Federal Highway Administration (FHWA), all Right of Way Certifications considered Conditional Right of Way Certification No. 3 and Special Right of Way Certification No. 3 with Work-Around (3W) as described in the Caltrans Right of Way Manual section 14.02.03.05 and 23 CFR 635.309(c)(3)(ii), will require FHWA approval.

Previously, the Right of Way Certification for Conditional Certification No. 3 and Special Certification No. 3 with a Work-Around (3W) on the National Highway System and Interstate projects only required approval by FHWA. Based on the current Stewardship and Oversight Agreement, all projects requiring a Right of Way Certification for Conditional Certification No. 3 and Special Certification No. 3 with a Work-Around (3W) will now require FHWA approval.

Approval of the Right of Way Certification for Conditional Certification No. 3 or Special Certification No. 3 with a Work-Around (3W) may take a minimum of two weeks for routing and signatures by Caltrans HQ Right of Way & Land Surveys and FHWA offices.
